On your behalf, we will conduct a preliminary trademark search of the United States Patent and Trademark Office records. We will search through trademark registrations and pending applications to determine whether the proposed Mark or a similar Mark is already registered to a third party. A preliminary search is a critical part of the process and can save our clients substantial costs. If the preliminary search reveals that the Mark is already registered or an application for the Mark is already filed at the USPTO, then you may determine that you do not wish to move forward with the Mark. This can save you considerable fees because the next step after conducting a preliminary search is to conduct a thorough trademark search by an independent search company. The fees associated therewith and a thorough review and opinion letter advising you on availability for filing would thereby be avoided. All of the aforementioned preliminary services are extended to our clients as a courtesy.

Once you feel comfortable with pursuing the proposed trademark and you possess ample information regarding the current available records at the USPTO, we will ask you to execute a retainer agreement engaging our legal services.
